Terms and Conditions

1. Scope of Application

These General Terms and Conditions apply to all orders placed by consumers via the Maybell's online shop at https://maybells.shop.

For the purpose of these terms, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.

3. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an non-binding online catalog.

By clicking the order button, the customer places a binding order for the products contained in the shopping cart.

The purchase contract is concluded only when the seller confirms the order by email or ships the goods.

4. Prices and Payment Terms

All stated prices are final prices and include the legally applicable VAT.

Additional shipping costs are separately indicated during the ordering process.

Available payment methods are displayed to the customer during the ordering process.

5. Delivery

Processing time is generally 3-7 business days after receipt of payment.

Delivery is made to the delivery address specified by the customer.

We assume no liability for delays caused by shipping service providers, customs authorities or other circumstances beyond our control.

6. Retention of Title

The goods remain the property of Maybell's until full payment has been received.

7. Right of Withdrawal

Consumers have a statutory right of withdrawal.

Details regarding the right of withdrawal and the conditions for returns are regulated in our Cancellation Policy.

8. Personalized Products

Products that are custom-made according to customer specifications or include personalized adjustments are excluded from the right of withdrawal.

This applies in particular to custom-made items, individual size adjustments, and products manufactured specifically to customer request.

Statutory warranty rights remain unaffected by this.

9. Warranty

Statutory warranty rights apply.

10. Liability

Maybell's is liable without limitation for intent and gross negligence.

In the event of slight negligence in the breach of essential contractual obligations, liability is limited to the foreseeable, typical damage.

Liability for damages resulting from injury to life, body, or health remains unaffected.

12. Online Dispute Resolution

The European Commission provides a platform for online dispute resolution:

We are not obligated and unwilling to participate in dispute resolution proceedings before a consumer arbitration board.

13. Applicable Law

The law of the Republic of Poland applies, excluding the UN Convention on Contracts for the International Sale of Goods.

For consumers, the mandatory consumer protection regulations of the state in which they have their habitual residence also apply.

14. Final Provisions

Should any provision of these General Terms and Conditions be or become invalid, in whole or in part, the validity of the remaining provisions shall remain unaffected.

Instead of the ineffective provision, the statutory provisions shall apply.
